If you are not at least 13 years old, you are required to have a parent or legal guardian subscribe for you. 1. The musical compositions sold by AWP remain the property of AWP and are licensed, not sold, to you for use in your musical and artistic efforts so long as you adhere to the rules of "synchronization". (See below) 2. A right to use AWP music is granted to the original end-user of the product (Licensee) and is not transferable. This license grants Licensee the non-exclusive right to use AWP music so long as additional audio and vocal performances are recorded against and with AWP compositions herein known as "synchronization", and for no other use unless a specific multimedia license has been requested and granted. Music used without synchronization in any form is not permitted under this license. If you have intentions of using AWP compositions without the act of synchronization, you must adhere to the terms under Section 5. 3. It is specifically understood and agreed that Licensee does not acquire any ownership rights or any underlying copyrights, and that Licensor retains all rights, title and interest in the music obtained from AWP, including all copyrights belonging to the original copyright holder, as well as any modifications or improvements made to the licensed property by Licensee. Customers shall give credit to owner of music (e.g. AWP) on any and all printed material(s) that accompany mediums which contain music owned by AWP. 4. The License expressly forbids resale or other distribution of AWP compositions, either as they exist or any modification thereof. You cannot sell, loan, rent, lease, assign, or transfer all or any of the products sold under AWP to another user, or for use in any competitive product. By purchasing from AWP you obtain an automatic license, privilege, and authority to use any Music Track(s) for demos, promotional recordings, websites, and independently distributed street/underground albums (not to exceed 1,000 copies sold) or any other type of similar use that you choose (such as Talent Shows and various other personal use, including but not limited to practice for singing, song-writing, rapping, and/or performing) within the restrictions according to the license. Instances not covered by this license require the acquisition of a separate license from AWP 5. Use of AWP compositions in isolation (without synchronization of vocal performances) is not permitted without obtaining a special Multimedia license directly from AWP. If you or your company is interested in using AWP compositions for Commercial Advertisements, Television Broadcasts, On-Hold & In-House Background Music, or Film Soundtracks you must contact AWP directly in order to be granted such a License. Unauthorized use or duplication is a violation of this agreement and of applicable laws of the U.S./Canada and other countries. Any infringement of copyright will be pursued to the fullest extent of the law. No-Refund Policy There are no-refunds on any licensed tracks purchased by you the customer. Limitation of Liability You expressly understand and agree that under no circumstances, including negligence, will AWP, its subsidiaries, affiliates, officers, directors, licensees or content providers be liable for any direct, indirect, incidental, special, exemplary, punitive or consequential damages that result from your use of or inability to use this site, including but not limited to reliance on information obtained from this web site, mistakes, omissions, interruptions, deletion of files or electronic mail, loss of or damage to data, errors, defects, viruses, delays in operation or transmission, or any failure of performance, whether or not resulting from Acts of God, communications failure, theft, destruction or unauthorized access to AWP, programs or services. You hereby acknowledge that this provision will apply whether or not AWP is given notice or has been advised of the possibility of such damages and that this provision will apply to all content, merchandise, products or services available from AWP, or its subsidiaries and affiliates.
